Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PageDuel (“Service”), operated by Bogdan Nichovski, Bünde, Germany. By signing up or using PageDuel, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
PageDuel is an A/B testing platform that allows you to create, manage, and analyse split tests on your websites. The Service is provided on a subscription basis with optional free trial access.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice, except where emergency action is required for security or legal reasons.
2. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at legal@pageduel.com if you suspect unauthorised access.
You must be at least 18 years old to use the Service. If you are using PageDuel on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.
3. Subscriptions & Billing
3.1 Plans
PageDuel offers the following paid plans (prices subject to change with 30 days' notice):
- Starter — for individuals and small projects
- Growth — for growing teams with higher traffic
- Scale — for high-traffic sites and larger teams
Plans are available on monthly or annual billing cycles. Annual plans are billed upfront and offer a discount compared to monthly billing.
3.2 Payment
Payments are processed by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis for the applicable subscription fee. All prices are listed exclusive of VAT; applicable taxes will be added at checkout.
3.3 Refunds
We do not offer refunds for partial billing periods. If you cancel a monthly subscription, you retain access until the end of the current billing period. If you cancel an annual subscription, no refund is issued for remaining months unless required by applicable consumer protection law.
Exceptions may be made at our discretion for billing errors or service outages exceeding 24 hours. Contact legal@pageduel.com to request a review.
3.4 Upgrades & Downgrades
You may upgrade your plan at any time; the price difference will be prorated for the current billing period. Downgrades take effect at the start of the next billing period.
4. Free Trial
New accounts receive a 7-day free trial with access to paid plan features. No payment method is required to start a trial. At the end of the trial, your account will automatically downgrade to free tier limits unless you subscribe.
We reserve the right to modify or discontinue the free trial offer at any time.
5. Acceptable Use
You agree not to use PageDuel to:
- Violate any applicable law or regulation
- Infringe the intellectual property rights of any third party
- Distribute malware, spyware, or any other malicious code via the tracking snippet
- Conduct A/B tests that mislead or deceive visitors in violation of consumer protection laws
- Attempt to gain unauthorised access to PageDuel systems or other customers' data
- Resell or sublicense the Service without our written consent
- Abuse free trial access by creating multiple accounts to circumvent limits
Violation of this section may result in immediate suspension or termination of your account without refund.
6. Intellectual Property
PageDuel and all associated software, designs, trademarks, and documentation are owned by Bogdan Nichovski or licensed to us. These Terms do not grant you any ownership rights in the Service. You may not copy, modify, distribute, or reverse-engineer any part of PageDuel.
7. Your Content & Data
You retain ownership of any content, configurations, and data you upload or create within PageDuel (“Your Content”). By using the Service, you grant us a limited, non-exclusive licence to store and process Your Content solely to provide the Service to you.
We do not sell or share Your Content with third parties except as necessary to provide the Service (see our Privacy Policy).
You are responsible for ensuring that Your Content and the websites on which you install our tracking snippet comply with applicable privacy laws (including obtaining necessary consent from your visitors).
8. Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other party and to use it only in connection with these Terms. This obligation survives termination of your account for 2 years.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or uninterrupted availability. We do not warrant that the Service will be error-free or that defects will be corrected.
Nothing in these Terms limits your statutory rights as a consumer under applicable EU or German law.
10. Limitation of Liability
To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the fees paid by you in the 12 months preceding the claim or (b) €100.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. This limitation does not apply in cases of gross negligence, wilful misconduct, or liability that cannot be excluded under applicable law (including liability under §§ 305 ff. BGB).
11. Termination
You may cancel your account at any time from your account settings. Cancellation takes effect at the end of your current billing period.
We may suspend or terminate your account immediately if you breach these Terms, particularly Section 5 (Acceptable Use). We will notify you of the reason unless prohibited by law. Following termination, your data will be deleted in accordance with our Privacy Policy.
12. Governing Law & Disputes
These Terms are governed by German law, excluding its conflict-of-law provisions. If you are a consumer located in another EU member state, you also benefit from the mandatory protections of your local consumer law.
We will always try to resolve disputes amicably. If a dispute cannot be resolved informally, the courts of Germany shall have jurisdiction. For consumers, the EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution proceedings.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
